11) Privacy and Data Protection
11.1 Privacy Policy
Our Privacy Policy describes how we handle personal data and is incorporated by reference into these Terms.
11.2 DPA
If you are a business customer and we process personal data on your behalf as a processor or service provider, the DPA applies where and as stated in the DPA.
12) Availability and SLA
Availability commitments, target uptime, service credits, maintenance treatment, incident communications, and any availability-related termination rights are governed exclusively by the SLA. Service credits, if any, are the sole and exclusive monetary remedy for SLA non-compliance.
13) Suspension and Termination
13.1 Suspension
We may suspend, restrict, disable, lock, hold, refuse, remove, or terminate access to the Service, an Account, zones, records, domains, APIs, domain-related features, or specific functionality immediately, with or without prior notice, if we reasonably believe such action is necessary or appropriate due to:
(a) actual or suspected compromise;
(b) a security, fraud, safety, or abuse risk;
(c) suspected or confirmed violation of these Terms, the AUP, the Anti-Abuse Policy, or other Policies;
(d) non-payment or chargeback risk;
(e) legal requirements, sanctions obligations, court orders, or lawful requests;
(f) registry, registrar, reseller, payment processor, upstream provider, or third-party enforcement action;
(g) the need to protect users, the Service, third parties, or the integrity, stability, or reputation of the DNS ecosystem; or
(h) extraordinary operational circumstances, emergency maintenance, or risk of material harm.
13.2 Termination by you
You may terminate these Terms by canceling your Account and discontinuing use of the Service, subject to any minimum billing commitment or non-cancelable term in an applicable Order Form.
13.3 Termination by us
We may terminate these Terms, your Account, or your access to the Service for repeated or material violations of these Terms or the Policies, continued non-payment, fraud, abuse, legal compliance reasons, sanctions concerns, insolvency-related risk, or if continuing to provide the Service would create material legal, operational, reputational, or security risk to us, the Service, or third parties.
13.4 Effect of suspension or termination
Upon suspension or termination, your license to use the Service ends to the extent of the suspension or termination. We may delete, disable, archive, or restrict access to Customer Content, account data, configurations, logs, tickets, billing history, and domain-related settings in accordance with our Documentation, Privacy Policy, DPA, backup retention practices, legal retention obligations, fraud prevention, abuse investigation needs, and security logging needs.
We are not obligated to maintain, export, forward, recover, or restore Customer Content, DNS configurations, logs, account history, or domain-related settings following suspension or termination except as required by law or expressly stated in Documentation or a paid feature we make available.
13.5 No liability for good-faith enforcement
We will have no liability for any suspension, restriction, lock, hold, takedown, deletion, refusal, or termination taken in good faith under these Terms, the Policies, applicable law, abuse-prevention obligations, or third-party compliance requirements.
14) DMCA / Copyright / Abuse Notices
Copyright complaints and counter-notices are handled under our DMCA Policy. Because Javelina is DNS infrastructure, we may not host the underlying content associated with a reported domain or subdomain. In many cases, the hosting provider, platform operator, content service, or registrar may be the more appropriate venue.
We reserve the right to evaluate and respond to notices involving phishing, malware, botnets, spam, fraud, impersonation, abusive infrastructure use, sanctions concerns, deceptive conduct, or other misuse under the AUP and Anti-Abuse Policy regardless of whether the complaint alleges copyright infringement.
15) Confidentiality
We implement reasonable administrative, technical, and organizational measures designed to protect non-public information you submit through the Service from unauthorized access, use, or disclosure. We may use and disclose such information as necessary to provide, maintain, secure, support, and enforce the Service and these Terms, to comply with law or legal process, to protect rights, safety, and security, or with your consent. This Section does not create a separate fiduciary duty or standalone nondisclosure agreement beyond these Terms, the Privacy Policy, and the DPA where applicable.
16) Export Controls and Sanctions
You represent and warrant that you are not located in, organized under the laws of, ordinarily resident in, or owned or controlled by any person located in a country or territory subject to comprehensive sanctions or embargoes applicable to the Service, and that you are not identified on any denied-party, blocked-party, or sanctions list maintained by any relevant governmental authority.
You will not access or use the Service in violation of export control, sanctions, customs, or trade laws or for any prohibited end use. We may suspend or terminate the Service immediately where we believe doing so is necessary to comply with such laws or to mitigate sanctions or export-control risk.
