Service: Javelina.cloud websites, dashboard, APIs, authoritative DNS network, domain-related services if offered, and related support services (collectively, the "Service")
These Terms of Service ("Terms" or "ToS") are a legally binding agreement between Irongrove LLC and the customer entity or individual accepting these Terms ("Customer," "you," "your"). By creating an Account, clicking to accept, accessing, or using the Service, you agree to these Terms.
Javelina.cloud is a service operated by Irongrove LLC.
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization, and "you" refers to that organization.
1) Definitions
"Account" means your Service account and related credentials.
"Affiliate" means any entity that directly or indirectly controls, is controlled by, or is under common control with a party, where "control" means ownership or control of more than fifty percent (50%) of the voting interests or similar power.
"Beta Services" means any alpha, beta, preview, pilot, early access, trial, experimental, or evaluation features, functionality, products, or services that we make available.
"Customer Content" means domains, zones, DNS records, record values, account inputs, support ticket materials, attachments, and any other data, content, or materials you submit to the Service.
"Documentation" means our published product documentation, knowledge base articles, service guidance, technical notes, and plan descriptions.
"Order Form" means any plan description, online checkout page, self-serve purchase flow, invoice, order confirmation, statement of work, or other purchasing instrument for the Service.
"Policies" means the documents incorporated by reference in Section 3.
"Service Data" means usage data, telemetry, analytics, logs, operational metadata, diagnostic data, performance information, and security-related information relating to the use, operation, support, and performance of the Service, excluding Customer Content except to the extent aggregated, de-identified, or anonymized.
2) The Service
2.1 DNS is infrastructure
The Service provides tools to create, manage, and publish DNS zones and records, to serve authoritative DNS responses, and to provide related account, API, domain, and support functionality. DNS changes may affect availability of websites, email delivery, verification workflows, TLS/ACME validation, service discovery, routing, application functionality, and other internet services. You are solely responsible for your DNS configurations, domain-related instructions, and the consequences of any changes you make or authorize.
2.2 No professional advice
Any information we provide, including through support, Documentation, knowledge base materials, status updates, incident communications, or automated assistance, is for general informational purposes only and is not legal, tax, financial, compliance, security, or other professional advice.
2.3 Third-party dependencies
Certain Service functions may depend on third-party providers, including registrars, registries, resellers, payment processors, identity providers, certificate authorities, upstream networks, public resolvers, anti-abuse partners, support tools, content delivery providers, cloud providers, or law-enforcement or governmental systems. We are not responsible for the acts, omissions, outages, delays, policies, decisions, or failures of third parties.
2.4 Service changes
We may modify, update, replace, suspend, or discontinue any feature, functionality, integration, API, protocol support, plan feature, or component of the Service from time to time. Where commercially reasonable, we will attempt to provide notice of material adverse changes to paid Service features. Nothing in these Terms obligates us to continue offering any particular feature or functionality for any period of time unless expressly stated in an applicable Order Form.
2.5 Beta Services
We may offer Beta Services from time to time. Beta Services may be changed, suspended, or discontinued at any time without notice, may not be appropriate for production use, may be subject to additional terms, and are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. Beta Services are excluded from any SLA, service commitment, indemnity obligation, and support commitment unless expressly stated otherwise in writing.
3) Incorporated Policies
The following Policies are incorporated into and form part of these Terms:
- Anti-Spoofing, Impersonation, and Abuse Policy ("Anti-Abuse Policy")
- Acceptable Use Policy ("AUP")
- Service Level Agreement ("SLA")
- Privacy Policy
- Data Processing Agreement ("DPA")
- Subprocessor List
- DMCA Policy
If we offer domain registration, transfer, renewal, privacy/proxy, DNSSEC, WHOIS/RDAP, or related domain services, applicable registry, registrar, reseller, ICANN, consensus policy, transfer, verification, and dispute-resolution rules may also apply and are incorporated by reference to the extent required for those services.
If there is a conflict among these documents, the following order applies:
(a) the DPA controls for data protection matters;
(b) the SLA controls for availability commitments, service credits, and availability-related remedies; and
(c) otherwise, these Terms control.
